TERMS & CONDITIONS

Payment

• A deposit of 50% is payable upon submission of this order, including GST.
• Acceptance of this order will be confirmed 90 days prior to the proposed delivery date and the balance of the Price together with an transport charges incurred by Oakfield Ltd. is payable on delivery and title in the plants shall pass only on payment in full to Oakfield Ltd. being made.

Delivery

Any period of dates quoted for delivery are to be regarded as approximate only and Oakfield Ltd. will not accept liability for any loss, damage or expenses consequent upon any delay in delivery of plants. Delay due to any circumstances outside the control of Oakfield Ltd. shall entitle the customer to cancel any order or to refuse to accept delivery unless advised to the contrary by Oakfield Ltd. in terms of the below clause thereof. Notwithstanding that the title to the plants may not have passed, the risk in the plans shall pass to the customer upon delivery.

That

Oakfield Ltd. will use its best endeavours and take all reasonable steps to meet the delivery date and if it is unable to meet the delivery date due to an event or circumstance (whether arising from natural causes, human agency or otherwise) beyond its control including (but without prejudice to the foregoing expression) strikes, lockouts or other labour disputes, riots, civil commotion, fire, flood, drought or plant or soil disease then I/we shall be so advised in writing and I/we shall then and only then be entitled to the full refund of any deposit paid but without interest and shall not be entitled to any penalty or claim for the damages for any loss arising in respect of such failure to deliver as aforesaid.

Should

I/we purport to cancel this order after acceptance at any time prior to delivery date then Oakfield Ltd. shall be entitled in its absolute discretion to forfeit the above mentioned deposit but without prejudice to its right to pursue any other remedies available to it for breach of contract.

I/We acknowledge

a. That I am/we are entering upon truffle growing solely in reliance upon my/our own judgement and not in reliance upon any representation or warranty advice or information made or supplied by Oakfield Ltd.

b. That this order shall not be binding upon Oakfield Ltd. until it has been duly signed as accepted on its behalf and a signed duplicate thereof delivered to me/us and the necessary deposit paid.

c. That the plants purchased are described as infected with Tuber melanosporum and that Oakfield Ltd. has taken all practicable steps to ensure that the likelihood of contaminating species of fungi being present on the plants is minimised by a high standard of quality control procceses.
